    What are expungements?

In legal terms, “expungement” is the procedure through which a document of a criminal sentence is damaged or secured from a state or government document.

An expungement order routes the court to deal with the criminal sentence as if it had actually never ever taken place, essentially eliminating it from an offender’s rap sheet along with, preferably, the general public document.

While individuals can have their record expunged at any age, you most frequently hear of children or minors having their record expunged once they turn a certain age.

In other words, an expungement is having your criminal record sealed or destroyed for a variety of different reasons.

Expungements must be ordered by a judge or a court.

    Michigan Expungement Laws

Expungement laws, like all laws in the US, vary from State to State.

In order to be considered for an expungement in Michigan, you must meet the following criteria:

    • You cannot have more than one felony on your record
    • You must wait at least 5 years after your conviction, probation completion, or jail sentence
    • You cannot have more than two misdemeanor offenses on your record
